By accessing or using clubdata.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.
2. Description of Service
clubdata.io provides a web-based platform that transforms golf simulator data into personalized digital yardage books. The Service allows users to:
- Upload CSV data from golf simulators (GSPro, TrackMan, and others)
- Organize and analyze shot data
- Generate personalized yardage books
- Access their data via web and mobile interfaces
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must provide accurate and complete information when creating your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Free and Paid Services
Free Tier: We offer a free tier that includes limited features. Free accounts have access to 14 clubs maximum and statistics from the last 10 shots per club.
Standard Tier: Paid subscriptions provide additional features including unlimited clubs, full historical data, equipment locker, and environmental adjustments. Subscription fees are billed annually and are non-refundable except as required by law.
5. User Data and Content
You retain ownership of all data you upload to the Service ("User Data"). By uploading data, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service to you.
You are solely responsible for:
- The accuracy and legality of your User Data
- Ensuring you have the right to upload and use such data
- Maintaining your own backups of important data
6. Acceptable Use
The Service is intended for personal, non-commercial use by individual golfers to analyze their own simulator data. You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Upload malicious code or content
- Resell or redistribute the Service without authorization
- Use automated systems, bots, scripts, or software to access the Service
- Scrape, crawl, harvest, or extract data or content from the Service
- Use artificial intelligence, machine learning, or similar technologies to access, analyze, or extract data from the Service
- Access the Service through any means other than the official web interface or authorized applications
- Reverse engineer, decompile, or disassemble any part of the Service
- Create derivative works based on the Service or its content
- Use the Service in any manner not expressly authorized by these Terms
Any use of the Service other than as specifically authorized herein, without our prior written permission, is strictly prohibited and will result in immediate termination of your account and may subject you to legal liability.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by clubdata.io and is protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.
8. Third-Party Services
The Service may integrate with or reference third-party services (such as golf simulator platforms). We are not responsible for the content, policies, or practices of any third-party services. Your use of such services is at your own risk.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Golf performance data and recommendations provided by the Service are for informational purposes only. We make no guarantees about the accuracy of distance calculations or their applicability to actual on-course conditions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLUBDATA.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless clubdata.io and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Service will cease immediately. You may request a copy of your data within 30 days of termination.
